Una sostanza o miscela esplosiva/pirotecnica può avere una diversa classificazione se:
- non fa parte di qualsiasi articolo e quindi consiste solo nella sostanza pura o miscela;
- fa parte di un singolo articolo pirotecnico;
- fa parte di uno specifico imballaggio di alcuni articoli confezionati in conformità con le norme di trasporto e stoccaggio applicabili (si noti che ci può anche essere una modalità di confezionamento diversa per lo stesso articolo pirotecnico e la classificazione può differire in conseguenza di ciò).
Inoltre, la classificazione per articolo si applica solo alla sostanza o alla miscela esplosiva e pirotecnica quando è parte di tale articolo. In particolare, se l’imballaggio è cambiato o è stato rimosso successivamente alla classificazione, quest’ultima deve essere rivalutata o ri-testata nelle nuove condizioni. L’assoggettabilità alla direttiva Seveso III è determinata dalla classificazione di questo articolo che si applica alla condizione nella quale l’articolo è normalmente tenuto. An explosive/pyrotechnic substance or mixture may have a different classification depending on whether it is:
- not part of any article and therefore consists only of the pure substance or mixture
- part of an individual pyrotechnic article
- part of a package of such articles packaged in accordance with the applicable transport or storage norms (Note that there also may be different packaging arrangements for the same pyrotechnic article and their classifications may differ accordingly.)
Moreover, the article classification only applies to the explosive and pyrotechnic substance or mixture when it is part of that article. In particular, if the packaging has changed or been removed since the article was originally classified, the classification must be re-evaluated or re-tested under the new conditions.
The coverage under the Seveso-III-Directive is determined by the classification of the article that applies to the condition in which the article is normally held on site. It should also be noted that only substances/mixtures belonging to articles
classified under UN/ADR as HD1.4 fall under category P1b of Annex I to the Seveso-III-Directive. This category does not cover substances or mixtures outside the UNADR classified packaging.
